Mark Doran Rallies for Employees’ Safety and Health Concerns

Mark Doran, Labour MP from Aberdeen North, presented a bill on Safety and Health in a recent debate in the House of Commons. He said that the Corporate Homicide and Corporate Manslaughter Act was introduced in 2007, but failed to address all the issues. Instead of starting new safety and health duties when it was implemented in April 2008, it became a decree of transgression.

In a comment on the present rules introduced in 2001 by the Health and Safety Executive (HSE), he said in the debate that that a large fraction of companies have not implemented the Act’s suggestions even though they were supportive of the regulations. He also stated that employers need to be encouraged to consider health and safety seriously, as the approach of voluntary implementation was not working. HSE’s research proved that regulation by law is more significant than voluntary acceptance.

About his bill, he said that it would keep the directors of various companies and other employers on the same level and force them to take rational steps for ensuring safety and health in all features of their organisation’s activities, and erase a serious glitch in the laws. The evidence was suggestive that it would help to secure the lives and jobs of individuals across the United Kingdom.

The Trades Union Congress, other trade unions, health and safety supporters, lawyers for personal injury and advocates of victims have requested for lawful and obligatory duties on managers and directors of organisations in the past. Now, with a Labour MP rallying for the provision of binding rules for safety on company owners, may be their requests will be fulfilled.

Company Fined by Court for Death of Contractor

The death of a 53-year-old contractor in March 2004 at a sugar refinery caused HSE to file a legal notice against Tate and Lyle Industries Ltd.

Keith Webb, who worked under Acclaim Logistics Ltd, was unloading a shipment of raw sugar at Tate and Lyle’s refinery at Factory Road in Newham when the incident happened. Webb was inside a bulldozer that was being brought down to a ship when suddenly, the lifting lug snapped and the bulldozer fell down onto the ship and rolled into the water, killing him instantly.

The incident prompted HSE to file a lawsuit against the company, and the latter was found to be in breach of Sections 2 (1) and 3(1) of the Health and Safety at Work Act 1974. In an October hearing at Southwark Crown Court, Tate and Lyle was ordered to pay a fine of £270,000 as well as costs of £90,000 towards damages.

HSE carried out a thorough investigation into the matter and found that work at the dock was not properly monitored by the company. The things that the company fell short of maintaining were proper procedures to navigate the ships that were to be unloaded, and failure to give proper directions to the staff.

According to John Crookes, an HSE inspector, Tate and Lyle was unable to meet even the basic standards of safety that were expected of them. Mr Crookes added that the company should be taken care that such an incident never happens again.

Court Finds Company Director Guilty of Violating Health Act 2006

The Operations Director at Metric Scaffolding UK Ltd was found guilty of violating section 7 of the Health Act 2006 by Leyland Magistrates. He was fined an amount of £175 in addition to £75 as costs and a £15 victim surcharge.

Operations Director, Martin Lenehan, was caught smoking at his desk by the officers of South Ribble Borough Council. The council issued him a fixed penalty notice with a £50 fine. He refused to pay then and was subsequently summoned to court.

However, during their follow up visit to the firm the council officers found that Mr. Lenehan was smoking at his desk in utter disregard to the notice. The incident took place in January.

Leyland Magistrates were given a brief about how Mr. Lenehan had ignored the warnings completely despite the company being warned in the past.

Councillor Peter Mullineaux said that the law was brought into existence to create a healthy non-smoking atmosphere at workplaces so that employees who did not smoke were saved from its dangerous effects.
